Thank you very much for your interest and your trust. Sudden Rush GmbH operates a travel agency based in Zurich and offers all services and products on of its own Internet platform.
The following General Terms and Conditions apply to all services of Sudden Rush GmbH (hereinafter referred to as SR)
1. Conclusion of the contract
With the confirmation of the written, telephone, electronic (online) or personal booking, a contract is concluded between the customer and SR. The present general terms and conditions are applicable to this contract. The customer is responsible for the correct provision of personal data (name and date of birth according to passport) to SR. It is also the customer’s responsibility to check all information for completeness and correctness after receipt of the invoice/confirmation. Any discrepancies must be reported to SR immediately. Any consequential costs arising from failure to report shall be borne by the customer.
2. Internet presence
SR strives to keep prices up-to-date. Nevertheless, due to the large number of data, information and parameters, deviations may occur. Prices and specifications result from the prices on the website of the suppliers or the individually prepared offer. Decisive is the booking confirmation and the price charged to the customer.
3. Terms of payment and prices
A deposit is to be paid upon receipt of the invoice/confirmation as stated on the invoice/confirmation. Unless otherwise stated on the invoice/confirmation, the balance must be paid at least 30 days prior to departure, without further request. For bookings made within 30 days prior to departure, the entire invoice amount is due immediately.
4. Booking process
4.1 Requesting quotations
Creating tailor-made arrangements takes time. As a specialist for individually arranged surf trips, SR strives to put together the perfect offer for all clients. There are no costs for the delivery of an initial offer. For each further offer, a handling fee of CHF 60.00 / EUR 55.00 will be charged. The costs will be charged after booking an arrangement.
4.2 Booking fees
For the For the service of compiling the trip, booking fees of CHF 60.00/ EUR 55.00 per dossier will be charged upon confirmation of the trip by the client. Collected.
For bookings requested less than 14 days before departure, SR will charge an additional express fee of CHF 60.00/EUR 55.00 per dossier, after final confirmation of the trip.
5. Validity of booked services
The booked services are only valid on the dates listed on the invoice/confirmation. We, therefore, recommend that you print out booking confirmations or keep them for other purposes.
6. Rebookings and cancellation regulations
In case of a rebooking or cancellation up to 31 days before the start of the trip, a processing fee of CHF 100.00/ EUR 95.00 per person will be charged. SR reserves the right to apply the conditions of the respective service provider for special travel offers (e.g. boat trips, campers). In general, please contact SR as soon as possible to find the best solution.
7. General provision for cancellations
In case of cancellation within 30 days before departure, the customer will be charged the following amount:
- 30 – 15 days before departure: 40% of the package amount
- 14 – 6 days before the start of the trip: 70% of the package price
- 5 days until the day of departure: 100% of the package price
7.1 Early cancellation of travel
If the customer interrupts his trip or changes services during the trip, there is no right to a refund. If the customer interrupts his trip or changes services during the trip, the (additional) costs will be charged to the customer.
7.2 Cancellation by SR
SR reserves the right to cancel the trip in case of force majeure, political unrest, strikes or failure to reach the minimum number of participants. In this case SR will refund the customer the amount paid. Further claims for compensation are excluded.
8. Price changes
In the following cases SR reserves the right to change the price:
- Price changes by transport companies and/or other service providers (third-party services)
- New or increased government levies or charges (VAT, airport taxes, security charges, change of course, etc.)
- Obvious printing and publication errors
9. Program changes
SR also reserves the right to change the travel programme or individual agreed services in the interest of the customer if unforeseen circumstances make this necessary. In the event of changes to an essential part of the contract, SR will inform the customer as soon as possible and will endeavour to provide an equivalent replacement service.
10. Travel insurance
The conclusion of travel insurance (cancellation costs and travel incidents) is strongly recommended to the customer. Such insurance is arranged by SR and can be taken out when booking a trip. If the customer waives the conclusion of an insurance policy, he confirms that he has sufficient private insurance coverage. The customer ensures that he is sufficiently insured for accidents and illnesses abroad.
11. Securing client funds
Through its membership in the Swiss Guarantee Fund, SR guarantees the security of the amounts paid in connection with a package tour.
12. Entry and Health Regulations
Each participant is responsible for the necessary travel arrangements (passport, visas and vaccinations). The regulations may vary according to nationality. SR recommends to inform yourself at the responsible consulate or embassy.
13. Disclaimers of liability
SR is not liable, if the non-performance or the improper performance of the contract is due to:
- neglect on the part of the customer;
- unforeseeable or unavoidable failures of a third party not involved in the provision of the contractually agreed services;
- force majeure or an event which SR or a service provider could not foresee or avert despite all due care.
SR is therefore not liable for changes in the itinerary due to strikes, riots, weather conditions, official measures, delays by third parties etc.
14. Data protection
14.1 Your data
SR requires various data (such as first and last name, date of birth, address, telephone number etc.) from the customers and fellow travellers for the correct processing of the contract. SR is subject to the Swiss Data Protection Act. SR is obliged to keep the customer data safe and stores it in Switzerland.
14.2 Transmission to service providers and authorities
SR only forwards your data as far as they are necessary for the contract processing with the service providers. These may be located abroad, where data protection may not correspond to Swiss standards. Both SR as well as the service providers may be obliged to forward customer data to (foreign) authorities due to legal regulations or official orders. This applies in particular, but not exclusively, to air [APIS]travel to the USA (Advance Passenger Information System , resp. TSA Secure Flight Program).
14.3 Enforcement of rights
SR reserves the right to forward customer data to authorities and third parties in order to enforce the legitimate interests of SR. The same applies in case of suspicion of a criminal offence.
15. Risk
All participants are responsible for choosing a trip that is appropriate to their state of health and personal physical abilities. SR points out that adventure trips, especially surfing trips, are associated with increased risk, this may be: Accidents which can lead to injury, disability or even death. SR declines any liability. All participants are responsible for themselves and bear all costs for accidents, death or damage to themselves or third parties.
16. Value added tax (VAT)
Any value added tax is not included in the prices listed.
17. Applicable law/place of jurisdiction
Swiss law is exclusively applicable to all disputes in the relationship between customers and SR. The courts of the city of Zurich/Switzerland are responsible.
